  • Offers information to help individuals understand their options for finding and changing family physicians
  • Operates a referral matching service to connect individuals seeking family physicians with healthcare providers who may be accepting new patients

2.2 What We Are Not

Doktr.ca is NOT:

  • A medical provider, clinic, or healthcare facility
  • A substitute for professional medical advice, diagnosis, or treatment
  • An emergency medical service
  • Affiliated with or endorsed by the Government of Ontario, Ontario Health, or any regulatory body
  • A guarantee that you will be accepted as a patient by any physician

3. ELIGIBILITY

To use this Website, you must:

  • Be at least eighteen (18) years of age, or the age of majority in your province or territory of residence
  • Be capable of forming a binding contract under applicable law
  • Not be prohibited from using the Website under any applicable law

If you are using the Website on behalf of a minor or another individual, you represent that you have the legal authority to do so.


4. USER SUBMISSIONS AND CONSENT

4.1 Information You Provide

When you submit information through our contact forms or physician matching service, you voluntarily provide personal information including but not limited to your name, email address, phone number, and general location.

4.2 Consent to Contact

By submitting your information through our physician matching form, you expressly consent to:

  • Doktr.ca contacting you via email, phone, or text message regarding your inquiry
  • Doktr.ca sharing your contact information with healthcare providers in your selected region who may be accepting new patients
  • Receiving communications from healthcare providers who receive your information

4.3 Withdrawal of Consent

You may withdraw your consent at any time by contacting us at hello@doktr.ca. Upon receiving your request, we will:

  • Cease all communications from Doktr.ca within five (5) business days
  • Make reasonable efforts to notify healthcare providers who have received your information, though we cannot guarantee third-party compliance

4.4 No Guarantee of Physician Availability

Submitting your information does not guarantee:

  • That a physician will contact you
  • That any physician will accept you as a patient
  • The timeline within which you may be contacted
  • The quality or suitability of any physician who contacts you

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Our Content

All content on the Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Doktr.ca or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes only.

5.3 Restrictions

You may not:

THE LIMITATIONS IN THIS SECTION APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF DOKTR.CA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.


10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Doktr.ca, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Website
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any information you submit through the Website

11. GOVERNING LAW AND JURISDICTION

11.1 Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

11.2 Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, located in the Regional Municipality of Halton, for the resolution of any disputes arising out of or relating to these Terms or your use of the Website.


12. DISPUTE RESOLUTION

12.1 Informal Resolution

12.2 Waiver of Class Action
